Guarantee:
Major Search Engines - We guarantee the client's website (domain) will be found on the first page of the top search engines such as Google, Yahoo and Bing (which combined represent 92% of all search engine traffic) and their respective partners (secondary search engines below) using single or multiple keywords provided by the client and the keywords related to the client's website content. The client's website will be found on the first page of at least one of the major search engines.
Secondary Search Engines/Partners - We guarantee the client's website (domain) will be found on the first page of the secondary search engines such as About, Alexa, AllTheWeb, Alta Vista, AOL, Ask (AskJeeves), Digg, Excite, Lycos and/or HotBot, etc. using single or multiple keywords related to the client's website content, service(s) or product(s). The client's website will be found on the first page of at least three of the secondary search engines.
Keyword Phrases:
We will work with all keyword phrases provided by the client and make every effort possible to bring said keywords phrases to the top of the major search engines like Google, Yahoo and/or Bing. However, the client must clearly understand that 'Organic SEO' campaigns cannot guarantee 'specific' keyword phrases on specific search engines. Instead our guarantee covers keyword phrase rankings related to the client's website product(s) and/or service(s).
Here is an example for a fictitious 'Dog Grooming Store' in Los Angeles whose company name is Dogs Love Suds, Inc. and whose domain name is www.dogslovesuds.com.
A typical scenario of keyword phrases in the first page of major search engines would include any of the following:
- Dog Groomers *(main keyword)*
- Dog Groomers Los Angeles
- Dog Groomers West Los Angeles
- Dog Shampoo Los Angeles
- Dog Grooming Supplies West Hollywood
- Dog Grooming Clippers Los Angeles
- Dog Grooming in Los Angeles
irst page rankings for the company name ie: 'Dogs Love Suds Inc', the domain dogslovesuds.com or results returning from a PPC campaign (Adwords, Sponsored Listings) do not constitute a successful first page ranking return . Google, Yahoo, Bing Local (maps) positioning (ranking) cannot be guaranteed in Google Local (maps), Yahoo Local (maps) or Bing Local (maps).
Ownership:
All SEO work prepared by Web Wise Media for the client's website belongs to the client permanently. The client will have complete ownership of all optimized content and all generated pages (if applicable). A detailed explanation of work performed along with associated files is forwarded to the client upon completion of assignment for them to keep.
Over-writing and re-installation:
WWM is not liable for lost placements, errors or non-delivery due to changes made to code by the client or client's agents. There may be a fee to re-apply SEO code (set-up files) on the client's website for any reason. If the client or client's agent makes changes to their website and does not incorporate the WWM optimization codes correctly or alters or removes the code, there could be a delay in achieving placements and providing placement reports, which shall under no circumstances be deemed a breach of contract by WWM.
Limitation of Liability and Mutual Indemnification:
WWM shall not be liable for any errors or omissions in any content placed on the internet. WWM will also not be liable for any delays in service due to act of God, action by any government entity, transportation, strike, network difficulties, electronic malfunction, etc. or any feasibility, reliability, or effectiveness unrelated to WWM. In no event will WWM be liable for any failure, disruption, downtime, disconnection, interruption, miscalculation, delay, inaccuracy, or any other nonperformance unrelated to WWM. WWM is not liable for any unlawful, fraudulent, or misleading action or statement made by its independent sales agents or any company, for which WWM is a reseller. If injured by such third parties, the client agrees to seek recourse solely against them and shall keep WWM free from any liability claimed against them.
Each party shall indemnify, defend and hold harmless the other party, other party's subsidiaries and affiliates, and the respective partners, agents, officers, directors and employees of each of the forgoing, from and against any loss, cost, expense, claim, injury or damage (including, without limitation, reasonable attorneys fees and expenses), whether incurred to third party claims or otherwise, arising or resulting from or caused by (i) any negligent act or omission or willful misconduct of either party or any consultant or engineer retained by either party, or any of its or their partners, directors, officers, employees, or agents; (ii) any breach or default by either party in the performance of any of its obligations under this agreement; (iii) any breach of any representation, warranty, covenant or agreement by either party; or (iv) any transactions with users, including without limitation any purchases by such users of products or services sold on the website.
Refund Policy:
No refund will be rewarded prior to the completion of the contract term. If WWM fails to achieve the guaranteed number of 1st page placements within the 12 month contract term, Client may obtain a prorated refund of its fees after additional services have been deducted at the end of the 12 month contract term.
Indexing and search engine ranking is subject to server uptime, server settings, DNS settings, website coding and/or optimized content remaining intact. These inconsistencies can be corrected but will delay indexing and ranking.
Performance refunds are subject to the conditions listed below.
Additional Disclaimers:
The client's website must not be a mass generated adult oriented sex site, a casino/gambling site, a dating site, a mass generated MLM get rich quick site, an online pharmacy, a generic web hosting site, a generic directory, a generic financial affiliate and/or lead generation site, a so called 'information' site (sites promoting ad sense, booklets, mortgages/reverse, getting out of debt, mortgages/home equity, loans, investments, credit cards), a website primarily selling Viagra or a website selling products/machines claiming the ability to make private body parts grow and/or a generic e-commerce 'dropshipper' site (that is, you don't own your inventory).
Although we do not guarantee such sites, we will optimize them exactly as we do for other industries, but will remove the guarantee and refund agreement. Our focus is competitive ranking. The proliferation of boilerplate sites in these industries mean that the only chance of traffic is comprehensive, professional optimization, as we offer with our first page ranking and Corporate SEO Programs.
